Lynas sues FMT, group over defamatory articles

KUALA LUMPUR (May 2, 2012): Lynas Corporation Limited and Lynas Malaysia Sdn Bhd have filed suits against the operator of online news portal 'Free Malaysia Today' (FMT) and the anti-Lynas group known as 'Save Malaysia, Stop Lynas', over defamatory articles on Lynas.
The two suits were filed separately at the Civil High Court registry on April 19.
In the first suit, Lynas Corporation of Sydney, Australia, and Lynas Malaysia named MToday News Sdn Bhd as defendant, while in the second suit, they named SMSL Sdn Bhd (Save Malaysia, Stop Lynas) and its two directors, Tan Bun Teet and Lim Sow Teow, as defendants.
In the suit, Lynas claimed that FMT on March 6, had published a defamatory article on its website while SMSL had published a defamatory article dated March 22, on its blogsite.
Lynas is seeking general damages and aggravated damages, costs and an injunction restraining the defendants from further publishing defamatory articles on Lynas.
The parties today met High Court Judge Datuk John Louis O'Hara in chambers when the case came up for mention.
SMSL's counsel, Datuk Bastion Pius Vendargon, told reporters that an ex-parte injunction application (one side) by Lynas to restrain the defendants from further publishing defamatory articles on Lynas was scheduled to be heard today.
He said, however, the court granted SMSL's application for the injuction to be heard as inter-parte (both parties).
He said the court fixed May 9 for case management for parties to finalise the affidavit and documents pertaining to the injunction application.
"After that, the court will set the date to hear the inter-parte injunction."
